A year ago this month, the MIC Coalition sent the following letter to the President of the United States, urging his Administration to promote music marketplace competition and efficiency by preserving the ASCAP and BMI consent decrees. At the time of submission, the coalition could not have imagined the toll that the COVID-19 pandemic would take on American businesses.
Our diverse coalition represents over 2.5 million American businesses in communities across every state. None of these restaurants, bars, hotels, public venues, broadcasters, or movie theaters were spared the devastating impact this crisis has had on the economy. The last thing they need is the loss of guardrails designed to keep music licensing fees fair and transparent.
Should the Antitrust Division decide to terminate, sunset or modify these decrees, it would introduce enormous disruption into the marketplace with immediate broad-ranging adverse economic impacts.
We urge the outgoing Administration to stand with America’s businesses and keep the decrees.
